Hunt Loses Appeal over Kennels Noise Ruling

A hunt kennels today lost its bid to overturn a noise abatement notice brought against its 74 hounds, according to a council spokesman.
The Isle of Wight Hunt brought the appeal at the Isle of Wight Magistrates Court in Newport against the order which was made last May at the request of the Isle of Wight Council.
The Isle of Wight Hunt Kennels Ltd was today given six months by District Judge John Woollard to abide by the notice.
The council spokesman said: “At the Isle of Wight Magistrates Court, District Judge Woollard heard evidence from noise and animal welfare experts, officials of the hunt, local residents in support of the hunt, complainants and council officers who have witnessed the barking and howling nuisance.
“The hearing concluded this afternoon (Wednesday May 26) when the District Judge dismissed the appeal, but amended the abatement notices to allow six months for the hunt to comply with the order, rather than the original 16 weeks.”
The spokesman said that today’s hearing was the second time the council had been forced to take action against the hunt.
He explained that the council felt it was necessary to resort to court action after negotiations had broken down.
The spokesman said: “Unfortunately, no progress was made and the complaints of nuisance continued.
“Accordingly, in September 2003 further abatement notices were served on several officials of the hunt including the chairman, secretaries, hunt masters and the Isle of Wight Hunt Kennels Limited, who own the kennels.”
Warren Haynes, the council’s environmental health manager, added: “We very much hope that the hunt will reflect upon this judgment and will make positive steps to abate the nuisance from the hounds.”
Where has common sense gone??
It is no secret that the hunt kennels were located here, so if they didn't want to hear hounds why on earth did they buy a house near the kennels???
